WHAT IS THE GOAL OF THE SEXUAL OFFENDER SECTION OF THE WAYNE COUNTY OFFICE OF SHERIFF WEBSITE?
The Wayne County Office of Sheriff recognizes that the internet is a very efficient way of disseminating information to the residents of Wayne County. Our goal is to inform our communities, by means of this notification, of the potential threat that is posed by convicted sex offenders that reside within our county. It is extremely important to remember that law enforcement is most often by nature largely reactive to incidents and rarely do agencies get the opportunity to give advance warning of potential threats. It is also important to note that anyone who uses this information to injure, harass, or commit a criminal act against any person may be subject to criminal prosecution.

WHAT DO THE DIFFERENT LEVELS MEAN?
There are three levels of risk, based on an offender's risk of re-offending:
Level 1 (low risk of repeat offense),
Level 2 (moderate risk of repeat offense),
Level 3 (high risk of repeat offense and a threat to public safety exists).
HOW ARE LEVELS DETERMINED?
Law enforcement agencies DO NOT determine risk levels or designations
As a general rule, the sentencing court will determine an offender's risk level either at the time of sentence (in probation cases) or when the offender is released from custody (in jail or prison cases). Because the court may not possess up-to-date information on an offender being released from prison or jail, SORA established a Board of Examiners of Sex Offenders to evaluate these cases and make a risk level recommendation to the court. The risk level assigned governs the amount and type of community notification authorized for a particular sex offender.
There are also three designations that may be assigned to a sex offender: sexual predator, sexually violent offender or predicate sex offender. These designations are also made by the sentencing court. These designations govern the duration of the offender's registration period.
WHICH OFFENDERS ARE LISTED ON THIS SITE?
In accordance with the New York State Sex Offender Registry Act (SORA), the Wayne County Office of Sheriff disseminates information about sex offenders as a NOTIFICATION TO THE COMMUNITY for entities with vulnerable populations. RELEASE OF INFORMATION CONCERNING SEXUAL OFFENDERS
In accordance with the New York State Sex Offender Registry Act (SORA), the local law enforcement agency where the offender currently resides, may, if it chooses, release information on sex offenders residing within their jurisdiction to "entities with vulnerable populations related to the nature of the offense." The law enforcement agency can now release information on level 1, level 2 and level 3 offenders. However, there is no community notification for sex offenders whose status is Pending. Also, while the exact address of level 3 offenders can be provided, the law provides that only an approximate address based on zip code can be provided for level 1 and level 2 offenders. An issue in the law does not allow the local law enforcement agency to be more specific about the residence of level 2 offenders but that information is available through the Sex Offender Registry. Please note that a federal court injunction currently prohibits the release of information through this method concerning sex offenders who committed their crime prior to January 21, 1996 and were assigned a risk level prior to January 1, 2000.
Please Note: A settlement has been reached in Doe v Pataki pertaining to the release of information for those covered by the injunction. Interested parties may view information about the settlement and download copies by visiting the DCJS site here.
Under the regulations currently established, we can only list offenders that are registered as living in Wayne County within villages and towns that do not have local law enforcement agencies.
